Section 338
Violation of Guthi

(1) If the Guthi operator does not fulfill the obligations to be fulfilled according to this paragraph, he shall be deemed to have violated the Guthi.
(2) In case of violation of Guthi according to sub-section (1), the Guthi operator who violates the Guthi shall be responsible for any loss or damage caused to the property of the Guthi or the beneficiary and he/she shall bear the responsibility for that.
(3) In case of incurring the liability according to sub-section (2), the owner of the guthi who violates the guthi shall bear the same amount of income or profit as the guthi or the beneficiary would have had if there had been no violation of the guthi.
(4) If there is more than one owner of a house, each owner of the house who violates the house shall be jointly liable for the loss and damage caused by the violation of the house.
(5) If there is a breach of the contract in one part of the contract and profit is received in another part, the owner of the contract cannot use such profit in fulfilling his obligations.
(6) Notwithstanding anything written elsewhere in this section, the guthi operator shall not be liable for any loss or damage related to the violation of the guthi in the following cases:-
(a) loss, damages,
caused by enforcement of law (b) Loss, damage caused by violation of the Guthi due to any act of the Guthi operator before him or as a result thereof.
(7) Notwithstanding anything contained elsewhere in this section, any person who commits any of the following acts in relation to a Guthi established and operating in accordance with the law in force immediately prior to the commencement of this Code shall be deemed to be in violation of the Guthi :-
(a) In case of not doing the work according to the deed of donation of Guthi, inscription or document of keeping such Guthi,
(b) If the land of the Guthi is sold, donated or pledged, or (c) Guthiar's movable property, except in the case of loss due to the custom of dealing with the work of the Guthiar.
(8) Violation of Guthi as per sub-section (7) shall be dealt with in accordance with the law in force at the time of commencement of this Code.
